1. Agreement
These Terms of Service (“Terms”) form a binding agreement between you (“Customer”) and Shape Your Brand LLC, a Florida (USA) limited liability company trading as RenderBeam (“we”, “us”) governing your access to and use of the RenderBeam pre-rendering service, dashboard, APIs, and websites (the “Service”).
2. Account
You must be at least 16 and able to enter into a binding contract. You are responsible for the security of your account credentials and API keys, and for all activity that occurs under them.
3. Free trial
New accounts get a 30-day free trial of the Starter tier with no credit card required. Trials are limited to one per domain and per person. We may end a trial early in cases of abuse or violation of these Terms or our Acceptable Use Policy.
4. Subscriptions, billing & usage
- Paid plans are billed monthly or yearly in advance through Stripe. Yearly plans receive a discount displayed at checkout.
- Usage is metered in “renders”. Cache hits are free and only fresh renders (cache misses) count toward your quota.
- The Starter tier enforces a hard cap at the included quota. Paid tiers support optional metered overages, capped at 100% of the base allowance to prevent abuse.
- Unused renders do not roll over from one billing period to the next.
- Prices may change with at least 30 days’ notice; the new price applies at your next renewal.
5. Cancellation, suspension & refunds
- You can cancel any time from the Plans page. Service continues until the end of the paid period; we do not refund partial periods unless required by law.
- United States/UK consumers have a 14-day right of withdrawal where applicable; this does not apply to usage already consumed.
- We may suspend or terminate accounts for non-payment, breach of these Terms, fraud, security risk, or abuse. Suspended accounts move to “deactivated” and after a retention period to “archived” for deletion.
6. Customer content & license
You retain all rights to the content of pages we pre-render on your behalf and to the data you upload. You grant us a limited, worldwide, non-exclusive license to host, cache, process, and serve that content solely to deliver the Service. We do not use customer content to train AI models.
7. Acceptable use
You must comply with our Acceptable Use Policy. In particular, you must not use the Service to host or pre-render illegal content, malware, phishing pages, infringing material, or content prohibited by our sub-processors' terms.
8. Service availability
We aim for high availability but do not guarantee uninterrupted operation. The Service is designed to fail open: if our edge worker or renderer is unavailable, requests fall through to your origin so human visitors are never blocked.
9. Intellectual property
The Service, including its software, design, and trademarks, is and remains the property of RenderBeam and its licensors. Nothing in these Terms transfers ownership to you.
10. Warranty disclaimer
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, or lost data. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or any liability that cannot be excluded by law.
12. Indemnity
You will defend and indemnify us against third-party claims arising from your content, your use of the Service in breach of these Terms, or your violation of applicable law.
13. Data protection
Our processing of personal data is described in the Privacy Policy. For B2B customers whose use of the Service involves processing personal data of United States/UK individuals, the Data Processing Addendum is incorporated into these Terms by reference.
14. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced by email and/or in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
15. Governing law & disputes
These Terms are governed by the laws of the State of Florida, United States of America, excluding its conflict-of-laws rules. The state and federal courts located in Florida shall have exclusive jurisdiction over any disputes, except where mandatory consumer-protection law of the customer's country of residence applies. Consumers in the United States/UK retain the protection of mandatory provisions of the law of their country of residence and the right to use the Online Dispute Resolution platform.
